Back in law school, I learned about how the law was shaped around owning stuff.

What does it really mean to “own” something anyway?

For most, it means that you have total control and ultimate say over what you do with your property. Even a child feels indignant when his mom takes his toy away.

In America, when you “own” something, you can pretty much do what you want with it. That is, unless and until it hurts someone (like weapons), or annoys someone (loud speakers), or impairs your home value (blocks your ocean view).

Also, if the government wants to build something where your stuff is, they can take your property and pay you for it and tell you to get lost (this is called “eminent domain”).

Similarly, when your mom dies (I figured that, since it’s Mother’s Day, we might as well get thematic), if she doesn’t have a will or a trust set up, the government will try to interfere with her property.

That’s right, you don’t just get to take over her property without the government (probate court) making sure that you’re taking it all fair and square and not ousting a long lost sibling somewhere.

This is, unless she set up a trust to transfer her property to make sure her kids won’t disturb her peace in the after life by fighting over her stuff after she’s gone.
